The Four Elements of Evidence DHA Requires

The Department of Home Affairs assesses partner relationships through four evidence pillars: financial evidence (shared finances and economic interdependence), social evidence (relationship depth and community integration), household evidence (cohabitation and shared living), and commitment evidence (future intentions and relationship permanence). To succeed, your application must present convincing documentation across all four elements. Weakness in any single category is a red flag.

Financial Evidence (10 Documents)

Financial evidence demonstrates economic interdependence and joint commitment to a shared life. Start with joint bank accounts: provide statements from the past 12 months showing regular deposits from both partners and shared spending (rent, utilities, groceries). If you haven't established a joint account, open one immediately and build 3–6 months of history before application.

Mortgage or rental agreements are essential. Both partners should be on the lease or mortgage, or at minimum, one partner should be on the lease with formal documentation showing the other partner's occupancy. Provide all tenancy agreements from the past 5 years if you've cohabited. Include utility bills (electricity, gas, internet) from the shared residence, dated within the past 3 months, showing both partners' names or at minimum the main resident and evidence the other partner receives mail there.

Tax returns and payslips are critical. Provide the past 2 years' tax returns for both partners. If one partner is supporting the other (e.g., during studies or relocation), include evidence of the supporting partner's income and ability to provide financial support. Life insurance policies or superannuation nominations listing the partner as beneficiary demonstrate long-term financial commitment. Vehicle registration or insurance policies in joint names, loan applications showing joint signatures, and evidence of joint savings (savings account statements) all contribute.

If one partner has sponsored the other on a spousal support basis, include all correspondence with the Department and evidence of financial support provided. For de facto couples, provide evidence of financial interdependence equivalent to married couplesβ€”DHA applies the same scrutiny regardless of marital status.

Social Evidence (10 Documents)

Social evidence demonstrates the relationship is integrated into community, family, and friend networks. Statutory declarations from friends and family members who have known you as a couple are invaluableβ€”these are written, sworn statements from independent third parties attesting to your relationship's genuine nature. Aim for 5–10 statutory declarations from people of varied backgrounds (family, friends, colleagues, community members).

Marriage or civil partnership certificates (where applicable) are primary evidence. For de facto couples, statutory declarations confirming cohabitation for 2+ years substitute for marriage certificates. Photographs of the couple together, spanning several years, demonstrate relationship history. Include photos from social gatherings, holidays, family eventsβ€”not just selfies. Wedding or commitment ceremony invitations, guest lists, and photos from the event are powerful evidence.

Social media evidence is increasingly important. Screenshots of Facebook relationship status, joint photos on Instagram, coupled email addresses (@couple-name.com), or joint online accounts (streaming services, fitness apps) show public commitment. However, ensure your social media presence is consistent with your application narrativeβ€”contradictions are noted by case officers.

Letters from community organizations (sports clubs, religious organizations, volunteer groups) confirming the couple's involvement are valuable. Joint membership in groups (book clubs, gym, hobby groups) evidences social integration as a unit. Correspondence showing the partners addressing each other affectionately or discussing future plans together strengthens social evidenceβ€”emails, letters, or chat messages (screen captured and dated) can be included.

Household Evidence (10 Documents)

Household evidence proves ongoing cohabitation and shared domestic life. Tenancy agreements for all properties where the couple has lived together are essentialβ€”maintain these from your first cohabitation to present. Mortgage or property ownership documents showing both names or the relevant supporting context are critical for couples who own property.

Utility bills (electricity, gas, water, internet) from the shared residence dated within the past 3 months are mandatory. Provide all bills for the past 12 months if you have them. Insurance documentation (home and contents insurance) in both names or covering both occupants is valuable. Health records showing the same address for both partners, or medical correspondence to the shared address, demonstrate cohabitation.

Furniture, white-goods receipts, or lease agreements for shared furnishings (especially major items like beds or sofas purchased together) show shared domestic investment. If one partner moved into the other's property, a tenancy agreement or letter from the property owner confirming the partner's residency for 12+ months is important. Childcare or school enrollment documents listing both parents/guardians and a shared address provide household evidence if applicable.

Proof of address change with Australian post office (change of address forms completed by both partners), voter registration showing both at the same address, and tax return addresses (if both filed from the same address) all contribute. For couples who have lived apart temporarily (work-related, visa processing), include a narrative explaining the separation and evidence of frequent contact, visits, or reunification plans.

Commitment Evidence (10 Documents)

Commitment evidence demonstrates the relationship is intended to be permanent and ongoing. Wills or estate planning documents naming the partner as executor or beneficiary show deep commitment. Superannuation or life insurance nominations listing the partner as beneficiary are standard commitment evidence. Joint savings accounts or investment accounts in both names demonstrate financial planning as a unit.

Future plans documentation is valuable: if the couple plans to marry, include engagement documentation or wedding invitations. If planning children, include correspondence discussing family planning or antenatal records if applicable. If planning relocation, include moving company quotes, property search history, or rental applications for a new shared residence.

Signed statutory declarations from both partners, separately, describing the relationship's nature, history, and future intentions are critical. These declarations should be genuinely written (not templated) and reflect your unique relationship story. Explicit discussion of commitmentβ€”"we intend to build our life together," "we have plans to start a family," "we are buying a home together"β€”strengthens commitment evidence.

Letters from employers confirming salary continuity or potential work opportunities in Australia (for the partner relocating) demonstrate commitment to the partnership's future in Australia. Proof of relationship registration (in states where de facto couples can register) is strong commitment evidence. If you've obtained relationship counseling or attended couples' courses, certificates or provider letters confirm relationship investment.

Presenting Your Evidence Effectively

The biggest mistake applicants make is submitting a disorganized bundle of documents. Instead, create a submission in four sections (financial, social, household, commitment), with each section prefaced by a table of contents and brief explanation of each document's relevance. For example:

"Financial Evidence – Joint Bank Account: Statements from [Bank] account [XXXXX] held in both names, covering January–December 2025, demonstrate regular monthly contributions from both partners and shared household spending of approximately $5,000 monthly."

This contextual framing helps case officers understand why you've included each document and how it contributes to the overall narrative. Without context, documents are meaningless.

Statutory declarations are your most important documents. They should be detailed, specific, and genuinely writtenβ€”not copied from templates. A 2–3 page declaration from a close friend describing how they met you, observations of your relationship's development, and specific examples of commitment is far more valuable than a 10-page generic declaration. Ensure declarations are properly sworn by a notary public or justice of the peace and dated within 3 months of application submission.

Common Mistakes to Avoid

Do not submit documents with personal details (bank account numbers, passport numbers) visibleβ€”redact sensitive information. Do not submit original documents unless explicitly requested; certified copies are standard. Do not submit documents in foreign languages without English translations. Do not include irrelevant documents (medical records unrelated to cohabitation, old tax returns from before the relationship) that create noise in your application.

Do not rely solely on statutory declarationsβ€”they must be supported by documentary evidence. Do not ignore gaps in your evidence timeline (e.g., if you haven't lived together for 1 year, explain why). Do not submit contradictory evidence (e.g., two different addresses listed as primary residences) without explanation.
